Hearing Designation Order, Order to Show Cause, and Notice of Opportunity for Hearing

On November 27, 2019, Auburn Network, Inc., filed applications with the Federal Communications Commission seeking renewal of the licenses of AM Station WANI, 1400 KHz, Opelika, AL; FM Station WGZZ, 94.3 MHz, Waverly, AL; FM translator W242AX, 96.3 MHz, Auburn, AL; FM translator W254AY, 98.7 MHz, Auburn, AL; and FM translator W294AR, 106.7 MHz, Auburn, AL. Auburn Network, Inc. also holds a Construction Permit for television station WHBD-LD, Channel 38, Auburn, AL, and has a pending application for a Construction Permit for a new FM translator, 105.1 MHz, Auburn, AL. On February 11, 2021, the Commission designated the foregoing applications and authorizations for an evidentiary hearing on the following issues: (a) to determine the effects, if any, of Michael G. Hubbard’s felony convictions on his qualifications and thus, the qualifications of Auburn Network, Inc. to be a Commission licensee; (b) to determine whether Auburn Network, Inc.’s Commission authorizations should be revoked; and (c) to determine whether the captioned application for an original construction permit for a new FM translator station at Auburn, AL, should be granted, denied or dismissed.
